Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms then You may not access the Service. You represent that you are over the age of 18.

Where you buy the application

You can obtain the Application in one of two ways:

  • From an Application Store. If You bought the Application through an Application Store, Your purchase was made under that Application Store's terms. Its terms govern the payment, billing, renewal, cancellation and refund of that purchase, and how the Application is licensed and delivered to You there. Questions about such a purchase go to the Application Store. These Terms govern Your use of the Application.
  • From Us, on Our Website. If You buy a Subscription on Our Website, We are the seller, and the sections SUBSCRIPTIONS BOUGHT ON OUR WEBSITE and LICENCE KEY AND ACTIVATION below also apply to You.

Each route covers only the trading platforms listed on the Website for purchase there. That list may change as We release the Application for more platforms. A Subscription bought on Our Website does not unlock a copy of the Application bought through an Application Store, and an Application Store purchase does not unlock the Application on other Host Applications. Neither route includes the Host Application itself or any market data. You need Your own licence for the Host Application and a market depth (L2) data subscription, and their own terms apply to them.

Subscriptions bought on Our Website

Plans. We offer a monthly and a yearly Subscription. Every plan gives the same Application; the plans differ only in price and billing period. The price of a plan is the price shown on Our Website at the time of purchase. The price, currency and billing period are also shown at checkout before You pay.

Payment. Payment is taken at the start of each billing period by Our payment and licensing providers, on Our behalf. Your card details are handled by Our payment provider; We do not receive or store them.

Taxes. Prices do not include taxes. Any applicable taxes, such as sales tax, GST/HST or VAT, are calculated and collected at checkout by Our payment provider and are added to the price.

Automatic renewal. A Subscription renews automatically at the end of each billing period, for the same period and at the then current price, and the payment method on file is charged, until You cancel. If You have a yearly plan, We send You a reminder email at least 30 days before each renewal.

Price changes. If We change the price of a plan, We tell every Subscription holder on that plan, monthly and yearly, by email at least 30 days before the new price applies to their Subscription. The new price applies from Your first renewal after that notice period. If You do not want to pay the new price, You can cancel before that renewal.

Plan changes. You can switch between the monthly and the yearly plan from Your Account (Manage your subscription). The new plan starts at the end of the billing period You have already paid for, at the then current price of that plan. Nothing is charged or credited on the day You make the change.

Cancellation. You can cancel at any time from Your Account (Manage your subscription) or by email to contact@stacksignal.com. When You cancel, the Subscription does not renew, and You keep access until the end of the billing period You have already paid for.

Refunds. Payments are non-refundable, except where the law requires otherwise. This includes a billing period You cancel part way through: You keep access until it ends, and the rest of the period is not refunded. The one exception We make Ourselves is in TERMINATION below.

Licence Key and activation

After checkout We send Your Licence Key to the email address You paid with, and You can also see it in Your Account. You enter the Licence Key in the Application's settings to activate it.

A Licence Key works on one computer at a time. To use the Application on a different computer, release the Licence Key on the old computer first, using Release This Computer in the Application's settings or Release computer in Your Account.

Your Licence Key is for You alone. You may not share, sell or publish it, or use it to run the Application for anyone else.

The Application needs an internet connection to confirm Your Licence Key with Our licensing provider. It confirms the Licence Key when it starts and from time to time while it runs. Whenever it cannot confirm the Licence Key, for example because Your computer is offline, the Application pauses and produces no output until it can confirm it again. When a Subscription ends, is cancelled and its paid period is over, or is refunded, the Licence Key stops working and the Application stops producing output.

Your account

When You buy a Subscription We create an Account for You on Our Website. You are responsible for keeping Your sign-in details safe and for activity in Your Account, and for keeping Your email address up to date so that We can reach You about Your Subscription. How We handle personal information on Our Website, including Your Account and purchases, is described in Our Privacy Policy at https://stacksignal.com/privacy/. If You bought a Subscription on Our Website, how the Application handles Your Licence Key and the data it needs to activate and confirm it is described in the Application's privacy policy at https://stacksignal.com/privacy/indicator/.

Service integrity and security

The Application performs integrity and security checks at startup, including verification of the Application version and of the host application binary it is running inside, and, for a copy activated with a Licence Key, a check of that licence. The Application may be remotely disabled, in whole or in part, if security issues are detected, including, without limitation, unauthorized modification of the Application, use of a deprecated Application version, or use of the Application within an unauthorized or pirated host application build. If Your access has been disabled and You believe this is in error, or for further information, You may open a support ticket by contacting contact@stacksignal.com.

Intellectual property

The Service and its original content, features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Patent notice

The design of the Application is protected by United States Design Patent Nos. D1,099,944 and D1,100,945. By accepting these Terms You acknowledge that You have received notice of the existence of these patents. No licence or other right under any patent of the Company is granted to You by these Terms, whether by implication, estoppel or otherwise, other than the limited right to use the Application as provided herein.

Your feedback to us

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and licence to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Links to other websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. If We terminate a Subscription bought on Our Website, its Licence Key stops working. If We end a Subscription bought on Our Website when You have not breached these Terms, We refund the unused part of the period You have paid for, in proportion to the time left in it.

Limitation of liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You for the Service, whether on Our Website or through an Application Store, in the 6 months before the event giving rise to the liability, or 100 USD, whichever is greater. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.

"As Is" and "As Available" disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service.

Governing law

The laws of the Province of Ontario and the federal laws of Canada that apply there, excluding their conflicts of law rules, govern these Terms and Your use of the Service, and the courts of Ontario have jurisdiction over any dispute about them. Nothing in these Terms takes away the mandatory consumer protections of the law of the place where You live, which still apply to You.

Changes to these Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. When a revised version of these Terms is released, the Application will present the revised Terms to You at launch, and Your continued use of the Service requires acceptance of the revised Terms. If You have a Subscription and do not accept the revised Terms, You may cancel it as described above. When the Terms change, We also tell every Subscription holder by email.

Risk disclosure. Futures and forex trading contains substantial risk and is not for every investor. An investor could potentially lose all or more than the initial investment. Risk capital is money that can be lost without jeopardizing one's financial security or lifestyle. Only risk capital should be used for trading and only those with sufficient risk capital should consider trading. Past performance is not necessarily indicative of future results. The possibility of profit is not equal to the possibility of loss: losses can be larger than any gains, and you can lose more than you invest.

The Pulling & Stacking Indicator is an analytical tool. It does not provide investment advice or trade recommendations, and nothing it displays is a signal to buy or sell.

Hypothetical performance disclosure. Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown; in fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk of actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all which can adversely affect trading results.

Chart images. The chart images on this site show the indicator's display on market data, to explain what it draws. They are not trading results or trade recommendations, and the risk and hypothetical performance disclosures above apply to them. We publish no trading performance.

Virtual currencies. Some chart images show cryptocurrency instruments. View CFTC advisories, as they contain more information on the risks associated with trading virtual currencies.

Trademarks. Stack Signal™ and Pulling & Stacking™ are trademarks of Stack Signal. Bookmap, MotiveWave and Sierra Chart are trademarks or registered trademarks of their respective owners. Stack Signal is not affiliated with, sponsored by or endorsed by those owners.
